These Terms govern your use of MyDigitalEra's website and services. By accessing www.mydigitalera.org or hiring us for a project, you agree to these Terms.
1. Services
We offer web and mobile app development, SEO, Google Ads, Meta Ads, WhatsApp automation, CRM setup, AI chatbots, creative design, and related growth services. The specific scope, deliverables, timeline, and price for each engagement are defined in a written proposal or invoice accepted by the client.
2. Engagement and Payments
- Booking — projects begin after receiving the agreed advance (typically 50% for one-time projects, or first-month fee for retainers).
- Balance — balance is invoiced on project delivery and is due within 7 days.
- Retainers — billed monthly in advance; cancellable with 15 days' written notice.
- Ad spend — client pays ad platforms directly. Our fees cover strategy, creatives, setup, and management only.
3. Client Responsibilities
- Provide timely access to accounts (website hosting, Meta Business, Google Ads, Analytics, CRM).
- Supply accurate business information, brand assets, and review feedback within 3 working days.
- Comply with platform policies (Meta, Google, WhatsApp) and applicable Indian law.
4. Deliverables and Revisions
Each package includes a defined number of revisions. Additional revisions or out-of-scope changes are quoted separately. Ad creative refreshes and optimization cycles are part of ongoing retainers at the cadence specified in the proposal.
5. Ownership
- Final deliverables (website code, creatives, ad copy) transfer to the client upon full payment.
- Third-party assets (fonts, stock photography, plugins) remain under their respective licenses.
- Ad accounts, analytics, CRM data — always owned by the client. We work inside client accounts.
- Portfolio use — we may feature completed work in our portfolio unless you request otherwise in writing.
6. Performance Disclaimer
Benchmarks shared on our site (ROAS 2.5x+, CPL reductions, lead volume) reflect past results on specific projects. We do not guarantee identical outcomes — ad performance depends on product-market fit, pricing, creative quality, competition, and platform changes outside our control.
7. Limitation of Liability
To the maximum extent permitted by law, our liability for any claim arising from our services is limited to the fees paid by the client in the preceding three months. We are not liable for indirect, incidental, or consequential damages (including lost profits or data).
8. Termination
Either party may terminate a retainer with 15 days' written notice. Fees for work already performed remain payable. Access to accounts, creatives, and deliverables is transferred to the client promptly on final payment.
9. Confidentiality
We treat all client data, strategy, and performance numbers as confidential. We will sign NDAs on request.
10. Governing Law
These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in Jharkhand, India.
